1. Who these terms are with
Baremont is a brand of WEEBPOLL TECHNOLOGIES INDIA PRIVATE LIMITED, registered at C/o Shri Parsa, Udaipur, Lakhanpur (Surguja), Chhattisgarh, India, 497116 ("Baremont", "we", "us"). "You" means the person or organisation that creates an account on cloud.baremont.in. By creating an account or placing an order you agree to these terms, our privacy policy, our acceptable use policy and our refund and cancellation policy.
2. Eligibility and your account
- You must be at least 18 years old and able to enter a binding contract.
- The details you give us, including your name, address and tax details, must be accurate and kept up to date.
- You are responsible for everything done through your account and for keeping your password and API keys secret.
- We may ask you to verify your identity before activating a service, and may refuse an order we cannot verify.
3. The services
We provide virtual private servers, cloud instances and dedicated servers ("services"). The specification, location and price of each plan are shown in the client panel at the time you order. We may change plans for new orders; a change to a service you already pay for takes effect only at your next renewal, and we will tell you at least 30 days in advance.
4. Prices, payment and taxes
- Prices are shown in the client panel. Goods and Services Tax (GST) and other applicable taxes are added to the invoice where the law requires.
- Monthly services are billed in advance for each billing period. Hourly cloud services are billed for the hours used and never exceed the monthly rate shown for that plan.
- Payments are processed by third-party payment gateways. We do not see or store your full card or bank details.
- An unpaid invoice may lead to suspension of the service after the due date and to termination, with deletion of its data, 7 days after suspension.
5. Your content and backups
You own the data you place on your servers. You are responsible for its legality and for keeping your own backups. Backups and snapshots that we offer are a convenience, not a guarantee; we are not liable for data loss except where it is caused by our gross negligence.
6. Acceptable use
You must follow our acceptable use policy. We may suspend a service immediately, without refund, if it is used for illegal activity, attacks on other networks, spam, malware, or anything that threatens our network or other customers.
7. Availability and maintenance
We aim to keep every service available at all times, but we do not promise uninterrupted service. We may carry out planned maintenance and will give notice in the client panel or by email where we reasonably can.
8. Suspension and termination
- You can cancel a service at any time from the client panel, as described in our refund and cancellation policy.
- We may suspend or terminate a service for non-payment, for a breach of these terms or the acceptable use policy, or when required by law or a lawful order.
- When a service ends, its data is deleted and cannot be recovered.
9. Limitation of liability
To the extent permitted by law, we are not liable for indirect or consequential loss, loss of profit, revenue or data. Our total liability for any claim is limited to the amount you paid us for the affected service in the three months before the claim arose.
10. Indemnity
You agree to compensate us for claims, losses and costs that arise from your content or from your breach of these terms or of the law.
11. Changes to these terms
We may update these terms. The date at the top of this page shows the latest version. Material changes are announced by email at least 30 days before they apply to existing services.
12. Governing law
These terms are governed by the laws of India. The courts at Surguja, Chhattisgarh have exclusive jurisdiction over any dispute arising from them.
